Why This Blog Matters

On June 27, 2025, the U.S. Department of Homeland Security (DHS) quietly proposed a rule that could turn international students’ lives upside down. The rule aims to scrap the longstanding “duration of status” (D/S) policy and replace it with rigid visa timeframes. What does that mean? Your ability to stay in the U.S. could now depend on ticking boxes within a pre-decided time limit – regardless of the academic or human reality.

For students and parents alike, this is not just a policy change. It’s a tectonic shift.

What’s the Big Change?

Old Rule: Under the “duration of status” model, F-1 and J-1 students could remain in the U.S. as long as they maintained valid student status – even if their studies extended beyond four years (as many programs do).

New Rule (Proposed): Students will be granted entry for a fixed time period – either the length of the I-20 or DS-2019 form, or a maximum of four years, whichever is shorter.

If the rule is finalized:

  • Students exceeding their time must apply for a visa extension, potentially mid-degree.
  • Those entering OPT or STEM OPT must apply for both work permission AND visa extension.
  • Any slip-ups may be counted as “unlawful presence,” a severe blow to your future U.S. immigration hopes.

The Psychological Toll

Imagine being 20, 8,000 miles from home, and having to navigate federal immigration bureaucracy – while managing exams, internships, and a part-time job. The uncertainty is paralyzing.

As Aaron Blumberg of Fragomen Law aptly put it: “For a 20-year-old studying in a foreign country, navigating such a process can be daunting.”

The Fallout: What the Numbers Are Telling Us

  • 30–40% decline in international student enrollment is projected this Fall, according to NAFSA.
  • That translates to:
    • 💸 $7 billion in lost revenue
    • 🧑‍🏫 Over 60,000 jobs at risk (faculty, staff, vendors)
  • Students from India, China, Nigeria, and Iran, who often require more than 4 years to graduate, will be disproportionately affected.
  • IMFS expects the number to fall by almost 70 to 80 % for 2025. The tragedy unfolding is that the numbers for 2026 are expected to be no better.

The U.S. Risks Losing Its Edge

Countries like Canada, Germany, and Australia are offering smoother pathways, post-study work options, and predictable visa policies. The U.S., meanwhile, is tying its own shoelaces together.

What You Can Do as a Student

Here’s how to future-proof your dream:

  1. Apply with Full Duration in Mind
    Include thesis semesters, internships, and unexpected delays when requesting your I-20.
  2. Stay Fully Compliant
    Maintain full-time enrollment. Don’t skip classes or miss deadlines. Stay alert and update your SEVIS record.
  3. Track the Federal Register
    The rule is still open for public comment. Make your voice heard. IMFS will keep you posted when it’s published.
  4. Plan Ahead for OPT/STEM OPT
    Include legal consultation fees and visa timelines in your academic plan.
  5. Have a Plan B
    Consider applying to universities in Australia, Canada, the EU, especially Germany, where immigration pathways are more transparent and student-friendly.

International students contribute more than $40 billion annually to the U.S. economy. They bring diverse perspectives, innovation, and cultural capital to campuses. To treat them as temporary visitors with arbitrary clocks ticking down is not just unfair – it’s short-sighted.

This rule doesn’t just impact students. It affects families, universities, and entire ecosystems of global education.
